1. General information

This website is operated and maintained by SCALEUP MARKETING LTD (hereinafter the "Company").

This document sets out the terms and conditions for using the website https://www.scaleupmarketing.co.uk/ (hereinafter the "Terms and Conditions" or the "Agreement"), establishing the conditions under which any person may visit or access the site, or use in any way the services offered through it (the "User").

Use of this website and of the services it contains is free of charge, provided the User complies with these Terms and Conditions. By using the site, the User implicitly agrees to comply with them.

If the User does not accept these Terms and Conditions, they must stop accessing the site immediately. Continuing to access or visit the site constitutes full and unconditional acceptance of the Terms and Conditions.

2. Changes to the Terms and Conditions

The Company reserves the right to change any provision of these Terms and Conditions at any time, without prior notice. Any change will be published on the site, in the footer. It is the User's responsibility to check this page periodically.

If the User no longer agrees to the Terms and Conditions and wishes to unsubscribe or have their personal data deleted, they should send an email to info@vladcerghezan.ro, asking to be removed from the site's database.

3. Protection of personal data

To ensure that users' right to data protection is respected, we have put specific safeguards in place, taking into account the requirements of Regulation (EU) 2016/679 (the GDPR), applicable across the European Union since 25 May 2018, and of the UK GDPR (as incorporated into UK law by the Data Protection Act 2018).

3.1. The data we collect

Personal data is supplied by Users at their own option when completing the forms available on the site (webinar registration forms, contact forms and so on). Registration asks for: first name and surname, email address, telephone number, and any other information relevant to the services requested.

3.2. Legal bases for collection

Personal data may be collected on the following bases: the data subject's consent; the performance of a contract; compliance with a legal obligation; and the legitimate interests pursued by the controller.

3.3. Purposes of collection

Personal data is collected for the following purposes: providing access to content and answering questions; sending communications, offers and benefits; managing registrations for webinars and events; sending educational and promotional material; monitoring site traffic; and improving the services offered.

3.4. How long data is kept

Personal data is held in a secure database until the user explicitly asks for it to be deleted, or for up to five years from the user's last activity on the site. After that period the data is anonymised electronically.

3.5. Users' rights

Under Regulation (EU) 2016/679 and the UK GDPR, Users have:

  • the right of access to personal data;
  • the right to rectification;
  • the right to erasure;
  • the right to restriction of processing;
  • the right to object;
  • the right to data portability;
  • the right to withdraw consent;
  • the right to lodge a complaint.

Complaints may be addressed to the National Supervisory Authority for Personal Data Processing (ANSPDCP) for users in Romania, or to the Information Commissioner's Office (ICO) for users in the United Kingdom.

4. Intellectual property

All content on the site, including but not limited to text, graphics, the technical sources of the services and any other material sent in any form to Users (viewed directly on the site, through newsletters, by email and so on) belongs to SCALEUP MARKETING LTD.

Site content may be used for personal purposes only. Any use of the content by third parties for purposes other than personal use requires the express prior written consent of the Company.

Copying, extracting, reproducing, publishing, transmitting, selling or distributing the content of this site for any purpose other than personal use is prohibited.

5. Use of the site

The site is free to access. The Company does not guarantee that it will be available at all times, without interruption. The Company may suspend, withdraw or modify the site in whole or in part without prior notice.

The site undertakes not to send spam and to use every technical means available to keep users' data secure and confidential.

6. Limitation of liability

The Company gives no warranties in respect of the site's content and can in no circumstances be held liable for any loss or damage arising from the use of any part of the site.

None of the information on the site constitutes a guarantee of income or profit; it is provided for information and education only. The results described in testimonials or case studies are specific to those individuals and are no guarantee that any other user will achieve identical or similar results.

In cases of force majeure, the Company and its representatives are entirely released from liability. Force majeure includes, but is not limited to: technical equipment failures, loss of internet connectivity, computer viruses, and unauthorised access to the site's systems.

7. Commercial communications and newsletter subscriptions

Users of the site may receive commercial communications, newsletters and notifications by email, SMS and WhatsApp. By completing the forms on the site (webinar registration, contact form), the User consents to receiving such communications.

Users may opt out of these notifications at any time, with a single click on the unsubscribe link in every email, or by sending a request to info@vladcerghezan.ro.

8. Cookie policy

This section concerns the cookies used on the website https://www.scaleupmarketing.co.uk/ and covers how cookies are used to monitor traffic, promote the site, keep it secure and display information correctly.

9. Governing law and disputes

The rights and obligations of the site's Users and of the Company are interpreted and governed in accordance with the law of the United Kingdom applicable at the Company's registered office, and with the European legislation on consumer protection and personal data, insofar as services are offered to users within the European Union.

Any dispute arising out of or in connection with these Terms and Conditions will be resolved amicably between the parties. If no agreement can be reached, the dispute will be settled by the competent court.
