concerning the processing of personal data in accordance with REGULATION (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (the "GDPR"), the UK GDPR (as incorporated into UK law by the Data Protection Act 2018) and the applicable legislation on the protection and security of personal data.

1. Personal data processed

The Company processes your personal data, in particular the following:

  • Data about you: first name, surname, age or date of birth (where provided);
  • Contact details: telephone number, email address, the town or city where you live, and postal address (where provided);
  • Other data relevant to the contractual relationship: personal data provided in order to attend a webinar run by SCALEUP MARKETING LTD;
  • Data you provide to us: by post, telephone, email, social media messages, WhatsApp or other communication platforms;
  • Communication history: your contact details and the history of electronic messages exchanged with the Company (including WhatsApp, Instagram and email messages);
  • Event recordings: audio and video recordings from webinars or other events run by the Company;
  • Data collected automatically: IP address, browser and device type, cookies, timestamps and your browsing history on the site;
  • Third-party tools: data collected through the Facebook pixel, Google Analytics and other advertising or analytics platforms.

Please also note that by registering for a webinar or completing any form on this site, you consent to receiving emails, SMS and WhatsApp messages from us. These may include information about the event, supplementary material, bonuses, educational resources and subsequent marketing communications.

2. Purposes of processing

The Company processes your personal data for the following purposes:

  • Managing registrations for webinars and events;
  • Presenting the Company's products and services;
  • Processing and recording your requests;
  • Sending promotional, educational and informational material;
  • Sending notifications by email, SMS or WhatsApp (offers, bonuses, resources);
  • Verifying the accuracy of data and preventing fraud;
  • Producing statistics and analyses (in anonymised form);
  • Personalising services and improving the user experience;
  • Measuring the performance of marketing campaigns;
  • Providing fast, effective support;
  • Managing correspondence and accounting records;
  • Archiving as required by law;
  • Administering the IT platform and securing our systems;
  • Complying with legal obligations (GDPR and UK GDPR).

3. Legal basis for processing

Depending on the case, the legal bases for processing personal data are:

  • Consent: Article 6(1)(a) GDPR;
  • Performance of a contract: Article 6(1)(b) GDPR;
  • Legal obligation: Article 6(1)(c) GDPR;
  • Legitimate interest: Article 6(1)(f) GDPR (the legitimate interests of the Company or of a third party).

4. Who will have access to your personal data

Your personal data is intended for use by the controller (the Company) and is disclosed to the following recipients where applicable:

Email marketing providers; SMS marketing providers; webinar platforms (such as Zoom); web analytics providers (Google Analytics, Facebook); hosting providers; tax and legal advisers; and the competent public authorities.

Data is disclosed to third parties only under contracts that guarantee the confidentiality and security of your data. As the Company is registered in the United Kingdom, international data transfers are carried out under the safeguards provided for by the GDPR and the UK GDPR.

5. How long we keep your personal data

Your personal data is kept for as long as the purpose of the processing remains.

Data collected through webinar registration forms is kept for the duration of the commercial relationship and until consent is withdrawn, but for no longer than five years from the last activity. Archiving is carried out in line with our legal obligations.

6. Your rights

Under the applicable law, you have the following rights:

  • 6.1. Right of access: To obtain access to, and copies of, your data.
  • 6.2. Right to rectification: To have inaccuracies corrected and incomplete data completed.
  • 6.3. Right to erasure: The "right to be forgotten", subject to legal limitations.
  • 6.4. Right to restriction of processing: Where the accuracy or lawfulness of the processing is contested.
  • 6.5. Right to data portability: To have your data transferred to another controller in a structured format.
  • 6.6. Right to object: To object to processing, in particular for direct marketing.
  • 6.7. Right to withdraw consent: At any time, actioned within a maximum of three working days.
  • 6.8. Automated decisions and profiling: The right not to be subject to a decision based solely on automated processing.
  • 6.9. Right to lodge a complaint: With the competent supervisory authority.

7. Important notes

Altering your data may prevent us from performing the contract, in which case the Company is released from liability. The information provided does not constitute any guarantee of income; results depend on individual implementation.
